Last Monday, the Court in The Hague ruled in summary proceedings initiated by the Stop5GNL Foundation against the State.

Summary judgment: auction of 5G frequencies can continue

There are no legal reasons to ban the auction of frequencies that can be used for 5G technology.

This is stated in the ruling of the District Court of The Hague on the summary proceedings that the Stop5GNL Foundation has initiated against the State. By means of these summary proceedings, the Foundation wanted to stop the upcoming frequency auctions and the introduction of 5G networks in the Netherlands.

Stop5GNL filed this summary proceedings because of their concerns about the health effects of 5G. The Knowledge Platform has previously reported that the 5G network, like current mobile networks, must comply with international exposure limits for electromagnetic fields. If exposure remains below the applicable limits, people are sufficiently protected against the currently known harmful health effects.

The Court bases its conclusion on the same sources as those used by the Knowledge Platform and literally says “The Court concludes that the State tailors its policy to reports from experts that must be assumed to have been drawn up properly. At least there are no concrete indications that these reports were prepared carelessly. The reports do not provide grounds for a (temporary) ban on the rollout of 5G.”

Regarding the application of precaution, the Court says: “The preliminary relief judge is of the opinion that the State implements the precautionary principle by applying the ICNIRP guidelines, by regularly checking whether the limits stated therein are not exceeded, by regularly conducting new research into new insights into possible harmful consequences of electromagnetic waves and by (the commitment) to (will) act accordingly.”
