Survivor's pension

Survivor's pension is the pension for the partner (partner's pension) and the children (orphan's pension) in the event of the death of the employee who participates in the pension scheme.

As a result of the WTP, the determination of the amount of the survivor's pension will change and a uniform concept of partner has been introduced.

Change in determining the amount of the survivor's pension

The amount of the survivor's pension is now based on the pension basis and the number of years of service between the date of commencement of employment and the retirement date included in the pension scheme. This is going to change.

 

After adjusting the pension scheme to the WTP, the survivor's pension is no longer dependent on the number of years of service (service independent).

In the new system, the survivor's pension in the event of death before the retirement date will be a percentage of the salary with a maximum of 50% for the partner's pension and 20% for the orphan's pension. This makes it clearer to employees what amount the partner and children will receive in the event of death. This change will have consequences for the amount of the partner's and orphan's pension for almost all employees.

 

The calculation method must be adjusted and comply with the WTP by January 1, 2028 at the latest.

Uniform partner concept

In current legislation and regulations, the concept of partner is defined as:

a) the husband;

b) the registered partner;

or c) the partner within the meaning of the pension agreement.

The latter ensures that pension providers have the freedom to determine whether - and if so under what conditions - they want unmarried cohabitants to be eligible for a partner's pension. The result is a great diversity in the interpretation of the concept of partner per pension scheme.

 

A Uniform partner concept has been introduced under the Future Pensions Act.

Uniform partner concept

  • - husband;
  • - registrated partner; or partner within the meaning of the pension agreement, being the adult person who runs a joint household with the employee or the former employee, unless it concerns a blood relative in the first degree, a blood relative in the second degree in the direct line, an adult stepchild or adult former foster child.

The criterion for qualifying for a partner's pension as an unmarried cohabitant without a notarial cohabitation contract is running a joint household.

 

Orphan's pension up to 25 years

Now the age up to which a child is entitled to an orphan's pension differs per pension scheme. The conditions and age limits vary, from 18 to 30 years. With the new pension rules, children receive an orphan's pension as standard until the age of 25.
