What we often see is that a Lithium battery BMS as a normal component is purchased. Nobody asks about safety, reliability and support. The rule is usually: "He who lives, will take care".
The risks appear to be limited, as there have not yet been any major liability lawsuits, even though there were already around 100 lithium fires in 2018.
If your battery pack is identified as an 'arsonist', insurers will definitely find you.

Also remember: A pack with good cells but a bad BMS is dangerous and a pack with bad cells but a good BMS is not dangerous but still functions reasonably well!

A well-designed BMS consists of a certain set of components, the costs of which are the same everywhere. 
The difference lies in how the components are used and whether and how the end result is tested and whether it is documented in such a way that it is also accepted by inspection authorities.

We therefore recommend:

• Provide a brief formulation of how you handle safety and warranty claims. Relate this to what your customers expect from you, and what may be legally expected.

• Look for any combination features between the battery and the device it is used in.

• Determine the total cost of purchasing, processing, and warranty claims.

• Have your battery and design checked and tested by a specialist.
